Esc Trips Terms and Conditions
Welcome to Esc Trips. Esc Trips is a holiday-planning and booking service operated by Enchante Brands Private Limited (“EBPL”, the “Company”, “we”, “us”, or “our”). The Company is incorporated under the Companies Act, 2013, and has its office at Unit 906-909, Sakti Statesman, 9th Floor, Green Glen Layout, No. 37/301/34/1, SY. No. 34, Ibblur Village, Begur Hobli, Bellandur, Bangalore, Bangalore South, Karnataka, India, 560103 (the “Office”).
These Terms and Conditions (“Terms”) are organised into three parts:
- Part A governs your use of the Platform itself;
- Part B sets out the commercial terms of your travel booking; and
- Part C sets out the legal terms that apply throughout.
These Terms, together with our Privacy Policy, and any other policy that the Company publishes from time to time (collectively, the “Additional Policies”), form a legally binding agreement between you and the Company. Each Additional Policy is published separately on the Platform. If you do not agree to these Terms or any applicable Additional Policy, you must not use Esc Trips.
PART A: PLATFORM TERMS OF USE
1. About the Platform
1.1. Esc Trips is a dedicated travel vertical of Escape Plan (together with its website, mobile pages, and any allied properties, the “Platform”), through which individuals (“User”, “you”, “your”) may discover destinations and the packages listed on the Platform, request customised itineraries, apply to join invite-only group trips (including trips with a Host), and book holidays designed and delivered by us. A package listed on the Platform, or an itinerary (including any activities or experiences you wish to undertake at your destination) and price agreed between you and the Company, is a “Package”. Once you select or agree a Package and make the required payment, your request becomes a confirmed booking (a “Booking”), which the Company is responsible for delivering in accordance with these Terms.
1.2. Certain Packages are accompanied by a content creator or influencer engaged by the Company (a “Host”). A Package that is advertised as accompanied by a Host is referred to in these Terms as a “Hosted Trip”. A Host does not host, organise or operate the trip. A Host joins the group as a participant and is engaged by the Company to keep the group fully engaged at all times.
1.3. Every Package is accompanied by one representative designated by the Company (the “Tour Captain”), who is your single point of contact on the ground from the arrival point stated in your itinerary to the departure drop stated in it, and who ensures end-to-end execution of your Package on the ground and provides all support during it.
1.4. Certain Packages, including every Hosted Trip, are offered by invitation only (each, an “Invite-only Package”). Each Invite-only Package is marked as such on its page on the Platform. To join one, you must first send us a request (a “Request”) and receive an invitation from us (an “Invitation”), as set out in Section 4, before you can book it. Other Packages may be booked without an Invitation.
1.5. Every element expressly stated as an inclusion in your confirmed Package, including stays, transfers, activities and the elements of your day-wise itinerary, is arranged and booked for you by the Company. Anything not expressly stated as an inclusion is not part of your Booking and is your own responsibility and cost.
2. Acceptance of Terms
2.1.1. By accessing or using the Platform, engaging with the Company through its official channels, or confirming a Booking through any channel, you acknowledge that you have read and agree to be bound by these Terms. If you do not agree to any part of these Terms, do not proceed with a Booking or use the services described in them.
2.2. The Company reserves the right, in its sole discretion, to amend these Terms at any time.
3. Eligibility to Use
3.1. Any individual using the Platform or entering into a Booking must be at least 18 years of age and possess the legal capacity to enter into a binding contract under applicable law.
3.2. A User may make a Booking on behalf of one or more individuals who will undertake the trip (each, including the User where the User also travels, a “Traveler”). Where a User does so, the User:
(a) represents that they are authorised to make the Booking on that Traveler’s behalf;
(b) accepts these Terms on behalf of each such Traveler; and
(c) remains responsible for ensuring that each Traveler complies with these Terms, for the accuracy of information provided in respect of each Traveler, and for all payments due under the Booking, regardless of which Traveler ultimately undertakes the trip.
3.3. On an Invite-only Package, a Request and an Invitation are personal to the person who made or received them. Each person must send their own Request and hold their own Invitation, and we do not accept a Booking for anyone who does not. Friends travelling together should each send a Request and mention each other; we will try to place them together but cannot guarantee that all of them will be accepted.
3.4. Every Traveler on an Invite-only Package must be at least 18 years of age at the date of departure, and we do not accept a minor Traveler on such a Package in any circumstances. For other Packages, a Traveler need not themselves be 18 years of age. A minor Traveler must at all times be accompanied by adult who accepts responsibility for them, unless the relevant Package is expressly designed and offered by the Company for unaccompanied minors. We may require proof of age for any Traveler.
3.5. The Company reserves the right to restrict or deny access to the Platform, or to decline or cancel a Booking, where a User does not meet the eligibility conditions set out in this Section.
3.6. A Booking, including a Booking for an Invite-only Package, is personal to the Travelers named in it. You may not transfer, assign, resell or otherwise make available your Booking to any other person, whether for value or not, except with our prior written consent and, where it is an Invite-only Package, subject to that person receiving an Invitation.
4. Requests and Invitations
4.1. Some trips, including every Hosted Trip, are by invitation only. To join one, send us a request in the format given on that trip’s page on the Platform (a “Request”). A Request needs, at a minimum, your name, your age, your social media handle or handles, and the other details the form asks for.
4.2. A Request may be raised with a minimal, non-refundable fee (the “Request Fee”), as communicated on the Platform from time to time. The Request Fee is shown before you pay it and is not refundable, whether or not your Request is accepted. If we close Requests for, or cancel the trip before reviewing your Request, we will refund it in full.
4.3. We review each Request on basic criteria: whether it is complete and accurate; whether you meet the eligibility conditions in Section 3; how well you fit the theme, pace and activity level of the trip; the size and balance of the group and the places available; and your conduct, including on earlier trips with us and in content publicly available on the social media handles you give us. We may verify your information and speak with you before deciding. We do not decide on any ground on which discrimination is prohibited by law.
4.4. We decide at our discretion, and a Request does not entitle you to an Invitation. A Request is not a Booking. We will tell you the outcome within 7 (seven) days, and we may close Requests for any trip at any time.
4.5. If we accept your Request, we will send you the acceptance and an Invitation for the trip by email or WhatsApp. An Invitation lapses if you do not book and pay the Booking Amount within 5 (five) days of its date. Your place is secured only when your Booking is confirmed under Section 12.
4.6. Where you join a group trip, the other Travelers on that trip (each a “Fellow Traveler”) are selected by us through this process.
4.7. We may withdraw an Invitation, or decline or cancel a Booking made under it, at any time before the trip where, in addition to our rights under Section 8, you no longer meet the eligibility conditions in these Terms; or you breach these Terms.
5. Use of Platform and Communication Channels
5.1.1. Esc Trips makes its services available through the Platform and through official communication channels, including email, WhatsApp, and the designated customer-support telephone number. You must use these channels only for lawful and genuine purposes. You are responsible for ensuring that all information you provide to the Company is accurate, complete, and up to date.
5.1.2. By initiating a query or Booking, you consent to receive transactional communications from the Company about your Booking. These may include booking and payment confirmations, payment reminders, cancellation notices, and other updates sent by WhatsApp, SMS, email, or telephone. You are responsible for providing a valid mobile number and email address that you can access. We will send you promotional messages only where you have opted in, and you can opt out at any time.
5.2. While we will take reasonable care to ensure accurate communication, we shall not be liable for any delay, loss, or miscommunication arising from incorrect or outdated contact information provided by you.
5.3. Before each group trip we may add you to a messaging group for that trip, which will include your Fellow Travelers, and the Tour Captain. A representative of the Company will be present in the group. The group exists for the purposes of that trip only, may not be used for marketing, solicitation or the promotion of any business, and will be closed after the trip ends. Anything you share in the group, including your mobile number and display name, is visible to the other members of it. If you prefer not to be added, tell us before the trip and we will communicate with you individually.
6. User Content, Reviews, and Testimonials
6.1. You may be invited to submit reviews, photographs, videos, or other content relating to your trip (“Submitted Content”). You represent that you own or have the necessary rights to the Submitted Content and that it does not infringe any third party’s rights.
6.2. By submitting such content, you grant the Company a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, and display it for marketing, promotional, and business purposes across the Platform and other media operated by the Company, unless you notify the Company in writing that you withhold this consent.
6.3. You shall not submit any content that is unlawful, defamatory, obscene, discriminatory, infringing of third-party rights, or otherwise inappropriate. The Company reserves the right, to review, remove, or refuse to publish any Submitted Content at its sole discretion.
6.4. You agree to indemnify the Company against any claim arising from Submitted Content you provide, including any claim that it infringes a third party’s rights.
7. Trip Content, Filming and Media Release
7.1. Trips are documented. You acknowledge that a Hosted Trip is, by its nature, a trip on which photographs, video and audio are captured and published. Material captured on or in connection with a trip by the Company, the Tour Captain, a Host, or any photographer, videographer or creator we appoint is referred to in these Terms as “Trip Content”.
7.2. You consent to being photographed, filmed and recorded during the trip, and you grant the Company a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, edit, adapt, translate, publish and otherwise exploit Trip Content in which you appear, including your image, likeness, voice and first name, for the Company’s marketing, promotional and business purposes, on the Platform, on social media, and through partners, creators and media. The Company may extend this licence to a Host for the purpose of that Host’s own content about the trip. You acknowledge that no payment is or will be due to you in respect of Trip Content, and you waive any claim to payment.
7.3. You may tell us in writing before the trip begins, or tell the Tour Captain at any time during the trip, that you do not wish to appear in Trip Content. We will then take reasonable steps to exclude you from Trip Content published after your request. We cannot withdraw material already published, and we cannot guarantee that you will not appear incidentally in a group, crowd or background image, or in content published by a Fellow Traveler, by a Host in their personal capacity, or by any third party.
7.4. You may take and post your own photographs and videos of your trip for your personal, non-commercial use. You may not use material from a trip, or your participation in one, for any commercial purpose, to promote or benefit a competing travel business, or in any way that states or implies that the Company or a Host endorses you, your business or any product, without our prior written consent.
8. Suspension and Termination
8.1. The Company may, in its sole discretion, suspend or terminate your access to the Platform or decline to process a Booking, with or without notice, where you breach these Terms, provide false, incomplete, or misleading information, or you misuse the platform or harass our staff or representatives, your conduct causes harm to our reputation, or other users.
8.2. In such cases, we may refuse or cancel any future Bookings and suspend or terminate any ongoing services, without any liability to you or any obligation to provide a refund. We reserve the right to take such other legal action as may be available to us, where necessary.
8.3. Any suspension or termination shall be without prejudice to any rights, remedies or obligations accrued prior to such suspension or termination, including any outstanding payment obligations or indemnities.
PART B: TRAVEL AND PACKAGE TERMS
9. Scope of Services
9.1. The Company offers a range of Packages across categories that may include, without limitation, individual or group tours, Invite-only Packages (including Hosted Trips), customised holidays, domestic tours, international tours, and short-duration getaways. The Company may introduce, modify, or discontinue any category of Package at its discretion.
9.2. A Package includes accommodation, meals (up to 2 per day), transfers, sightseeing, and services such as destination activities, experiences (such as workshops, excursions, etc.). In connection with your Package, you may also opt for flights, visa advisory and documentation assistance, an eSIM or local SIM card, a forex card or foreign currency, or travel insurance (each, an “Additional Service”). Where you opt for an Additional Service, it will be provided to you by a Service Provider licensed or authorised to provide it under applicable law, subject, in the case of travel insurance, to Section 18, and is governed by these Terms together with that Service Provider’s terms. The Company only facilitates these Additional Services: the licensed Service Provider supplies, activates or issues them and is responsible for the service and its regulatory compliance. Certain Additional Services may be offered as complimentary promotional inclusions with a Package, on the terms stated in the offer. Each Package will set out the specific services included in it at the time it is confirmed with you, and only the inclusions expressly stated in your confirmed Package form part of your Booking.
9.3. Certain elements of your Package (such as transport, accommodation, activities, or other travel services) may be provided by a third party (a “Service Provider”) and may be subject to that Service Provider’s own terms and conditions, which apply in addition to these Terms. We act as a facilitator not as the direct operator of these services. Packages are delivered by the Company together with its partner operators and other Service Providers.
9.4. The Company shall not be liable for any act, omission, delay, or default that is beyond its reasonable control, including any act, omission, delay, or default of a third party referred to in Section 9.2 and 9.3, without prejudice to Force Majeure and Limitation of Liability below.
9.5. Accommodation, transfers and flights are subject to the terms of the relevant Service Provider. Check-in and check-out times, room types and facilities vary by property, and facilities such as hot water, power and connectivity may be limited at remote locations. The Company may substitute a property of a similar category where needed. Transfers follow the itinerary and are not available on call. Flight tickets follow the airline’s fare rules and are generally non-refundable.
10. Hosted Trips and Hosts
10.1. On a Hosted Trip, a Host joins the group for the whole or part of the trip, as specified in the Package, to keep the group fully engaged at all times, take part in the itinerary and group activities, and create content relating to the trip. The trip shall otherwise be operated in the same manner as any other Package. The Host is a participant and not the organiser, operator, guide or instructor of the trip, and shall not be responsible for the operation or safety of the trip, nor shall the Host be deemed an agent, employee or representative of the Company. The Tour Captain remains responsible for on-ground execution and support.
10.2. Any content posted or statement made by a Host, whether on social media or otherwise, is the Host’s own and is not a representation by the Company. For the particulars of your Booking, you should rely only on the written confirmation of your Package issued by the Company.
10.3. The Company may change the Host for a trip at any time, for any reason, at its discretion. If a Host is unable to join or leaves early, the Company may proceed without a replacement. Where we notify you of a change of Host, or that the Host will not be joining, before the trip begins and you do not wish to continue with the replacement Host, you may, within seven (7) days of our notice, transfer to another trip of the same or a comparable Package, subject to availability and to any difference in price, or receive a credit note for the amount paid; if you do not tell us your election within that period, your Booking continues with the replacement Host.
10.4. You must not engage a Host to provide travel services outside the Platform, or make any payment to a Host, in connection with a trip.
10.5. A Host has no authority to accept bookings, payments, changes or refunds, or to make any promise on the Company’s behalf. Please raise any concern about your trip with the Tour Captain or the Company, not with the Host.
11. Your Tour Captain
11.1. Each Package is accompanied by one Tour Captain, who is with the group from the arrival point stated in your itinerary to the departure drop stated in it. The Tour Captain coordinates your arrival, check-ins, transfers, activities, meals and departure, holds your vouchers and confirmations, is contactable throughout the trip, and is your first point of escalation on the ground.
11.2. The Tour Captain may give instructions about timings, assembly points, transport, safety, conduct and compliance with local laws and customs, and may alter, re-sequence, shorten or omit any part of an itinerary where weather, road, permit, health, safety, security or regulatory conditions require it. You must at all times follow all Tour Captain’s guidelines and instructions.
11.3. The Tour Captain is responsible for the group as a whole and is not a certified instructor for any adventure or technical activity unless your Package expressly says so. Specialist guides and activity operators, where included, are arranged separately.
11.4. You may step away from a group activity or any part of the itinerary only after informing the Tour Captain and agreeing a time and place to rejoin the group. You are responsible for your own safety while you are away from the group. Any cost, loss or expense arising from your stepping away from the group, or from your failure to rejoin it at the agreed time, shall be borne solely by you, and neither the Company nor the Tour Captain shall be liable for it. If you do not rejoin the group at the agreed time, the group may proceed without you.
11.5. If you are involved in, or become aware of, any accident, injury, illness, loss, theft, harassment or other incident during a trip, you must tell the Tour Captain immediately and, where the circumstances allow, also report it to us through our official channels. The Tour Captain may arrange medical attention, evacuation or other emergency assistance where required. The cost of such assistance shall be borne by you or your insurer, and where the Company pays any such cost on your behalf, you shall reimburse it to the Company.
11.6. You must behave respectfully towards Fellow Travelers, the Tour Captain, any Host, our personnel, Service Providers and local communities, comply with applicable law, local customs and the rules of every property, vehicle and activity operator, and carry valid government-issued photo identification throughout the trip. You must not carry or consume narcotics or other banned substances, carry weapons, fireworks or other hazardous items, or consume alcohol to an extent that endangers or disturbs others.
11.7. The Company or the Tour Captain may remove you from the trip, or from any activity, property or vehicle, without refund, where you breach this Section or a safety instruction, or your conduct is unlawful, abusive or endangers or seriously disturbs others. You will bear all costs arising from the removal and are liable for any damage you cause to property.
11.8. Please look after your belongings and valuables. We are not responsible for the loss, theft or damage of your personal belongings, documents or valuables during a trip, except where caused by our negligence or as required by law.
12. Booking Process and Confirmation
12.1. You may book a Package listed on the Platform by selecting it and paying the Booking Amount, or submit a request for a customised Package through the Platform, including details such as your intended destination, dates, budget, and number of Travelers. For an Invite-only Package, you must first send a Request and hold a valid Invitation, as set out in Section 4.
12.2. Before your Booking is confirmed, you must submit documents necessary to process it, which may include a valid government-issued photo identification, a passport copy, proof of age for a minor Traveler, or such other document as the Company or a Service Provider may require. The Company may decline or delay a Booking where such documents are not furnished.
12.3. For a customised Package, the Company will work with you to design and finalise a Package and its price, which will be communicated to you through WhatsApp. Any itinerary, price, or availability shared with you before such finalisation is indicative only and not binding on the Company.
12.4. A Booking is confirmed only upon the receipt of the Booking Amount and any other amount payable at booking under Section 14.1, or full payment by the Company. The Company will send you a booking confirmation, along with a payment confirmation through WhatsApp and/or by email.
12.5. No Booking is guaranteed merely by submission of a request, by any prior discussion, or by receipt of a quotation.
12.6. The Company will provide you with pre-trip information and on-ground contact details in advance of your trip and may contact you during your trip in connection with your Booking.
13. Pricing, Taxes, and Changes
13.1. The price of your Package will be stated in Indian Rupees (unless stated otherwise) at the time of booking and is subject to change until your Booking is confirmed in accordance with Section 12.
13.2. Unless expressly stated to be inclusive, the price of your Package does not include applicable Goods and Services Tax (GST) and other statutory levies, which will be charged in addition and reflected before you complete payment. Any tax, levy or charge payable locally at the destination and not included in the price will be specified in your Package.
13.3. Where applicable, the price of your Package may be subject to Tax Collected at Source (TCS) under the Income Tax Act, 1961, which the Company will collect from you, over and above the base price, and deposit with the relevant authority in accordance with law. You may be required to furnish your Permanent Account Number (PAN) and other information necessary for this purpose, and the Company may decline or cancel a Booking where such information is not furnished or is found to be invalid.
13.4. Where your Package involves foreign exchange, the price is subject to fluctuation in the applicable exchange rate between the date of booking and the date of actual payment, and any resulting difference will be payable by you. You are responsible for ensuring that your use of foreign exchange for your Booking complies with the limits and requirements prescribed under the Liberalised Remittance Scheme (LRS) and other applicable Reserve Bank of India regulations.
13.5. You shall indemnify and hold the Company and its representatives harmless from any liabilities, penalties, interest or legal consequences arising due to false, misleading or incomplete declarations or non-compliance with the provisions of applicable laws. This includes but is not limited to incorrect disclosure of PAN, residency status, purpose of travel or source of funds.
13.6. Unless your Package states otherwise, the price of a group trip is quoted per person on a twin- or triple-sharing basis. A single occupancy supplement applies where you ask for, or we are unable to allocate you a roommate for, a room to yourself, and will be notified to you before you confirm.
13.7. The Company reserves the right to revise the price of a Package before it is confirmed, including on account of changes in exchange rates, fuel surcharges, government-imposed taxes or levies, or price revisions by a Service Provider. Where any such revision arises after your Booking is confirmed and is outside the Company’s reasonable control, the Company will inform you of the revised price.
13.8. Offers, discount codes and promotional prices apply only as stated in the offer, cannot be combined unless stated, have no cash value, and are not refundable or transferable. We may withdraw an offer, or cancel a Booking made through its misuse.
14. Payment Terms
14.1. A Booking must be secured by payment of an advance amount (the "Booking Amount"), as mentioned in the Package, payable at the time of booking. In addition to the Booking Amount, you must pay at the time of booking the full cost of any flights you opt for as an Additional Service, and of any other component that is non-refundable or that a Service Provider requires to be paid in full at the time of booking, as notified to you before you pay. The Booking Amount is non-refundable, except as expressly set out in Section headed “Cancellation and Refunds”.
14.2. The balance of the Package price is payable in one or more further instalments, so that the total amount paid by you reaches the percentage of the Package price shown in the table below by each stated number of days before departure. The following illustrates the general structure of the Company’s payment schedule; the actual schedule may vary by Package type and will be communicated to you at the time of booking:
| Package Type | Total Amount Paid (as a percentage of the Package price) |
|---|---|
| Domestic group trips and short-duration getaways | At Booking: 15% (Booking Amount) 21 days before departure: 50% 15 days before departure: 100% |
| Short-haul international group trips | At Booking: 15% (Booking Amount) 52 days before departure: 50% 37 days before departure: 75% 27 days before departure: 100% |
| Long-haul international group trips | At Booking: 67 days before departure: 50% 52 days before departure: 75% 37 days before departure: 100% |
14.3. The payment schedule applicable to your specific Package, including the amount and due date of each instalment, will be confirmed to you in writing (including by email or WhatsApp) at the time of booking. Invite-only Packages, including Hosted Trips, follow the schedule for group trips of the relevant type. Whether an international Package is short-haul or long-haul will be stated in the Package. The schedule for a particular Package may differ from the standard schedule because of destination requirements, peak travel periods or special events, or a Service Provider’s payment deadline; where a Service Provider requires earlier payment, that earlier deadline will apply.
14.4. Payment may be made by such methods as the Company makes available from time to time, which may include credit or debit card, net banking, UPI, bank transfer, or such other payment method as is offered on the Platform or otherwise communicated to you.
14.5. All payments must be made through the payment methods made available on the Platform or otherwise communicated by the Company, and only to the Company’s officially designated bank accounts or payment channels. The Company does not authorise any employee, representative, Tour Captain, Host, or third party to accept payment into a personal or unofficial account and shall not be liable for any payment made to an account or person not officially designated by it; no refund or adjustment will be made in respect of such a payment.
14.6. You are advised not to share sensitive payment information (such as card numbers, CVV, OTPs, or online banking credentials) with any person, including anyone representing the Company. The Company will never ask you for your OTP or card PIN.
14.7. At the time of booking, the Company will inform you which portion of the Package price is refundable, and which is non-refundable if you cancel. Generally, certain components of your Package (such as flights, visa assistance, event or activity tickets, or specific hotel bookings) may be non-refundable once booked, regardless of the general payment or cancellation terms otherwise applicable to your Package; this will be indicated to you before you confirm your Package.
14.8. Amounts paid towards your Package may be forfeited, in whole or in part, in the following circumstances: (a) cancellation by you, to the extent provided in Section 16; (b) a no-show, as described below; (c) cancellation of your Booking by the Company for a breach of these Terms, suspected fraud, or misuse; and (d) forfeiture of a non-refundable component described in Section 14.8, whether or not you cancel the remainder of your Package.
14.9. If you fail to pay any instalment of the Package price by its due date, the Company may, without further notice, treat your Booking as cancelled, and any amount already paid will be dealt with in accordance with the cancellation terms.
15. Rescheduling
15.1.1. You may request a change to your confirmed Package by contacting the Company in writing through its official channels. A requested change may include new travel dates for the same destination and Package, a different Package or destination, a change in the number of Travelers, or a change to the inclusions.
15.1.2. You must submit a modification or rescheduling request within the minimum notice period shown below, or within any different period communicated to you when you book. The Company may be unable to accommodate a late request and may instead treat it as a cancellation under Section 16.
| Package Type | Minimum Notice Required |
|---|---|
| Invite-only trips | No modification/rescheduling allowed |
| Short-duration group trips | 15 days or more before departure |
| Domestic group trips | 30 days or more before departure |
| International group trips | 60 days or more before departure |
15.2. A reschedule is subject to the following conditions: (a) a free reschedule applies only to the first change of travel dates, and only where the request is received within the period shown above; (b) the new dates are subject to availability and to approval by the relevant Service Providers; (c) promotional or non-refundable Bookings may not be eligible for rescheduling; (d) the rescheduled trip must be completed within twelve (12) months of the original travel date; (e) you will be liable for any difference in the Package price and for any additional cost of flights, accommodation, visas, permits or upgrades, which will be communicated to you and must be paid before the reschedule is processed; and (f) a reschedule is valid only once the Company confirms it in writing.
15.3. The Company may need to change a confirmed Package, including its itinerary, inclusions, or dates, due to circumstances beyond its reasonable control (including those described in Section 21 (Force Majeure), a Service Provider’s own operational requirements, or safety or regulatory considerations). Where this occurs, the Company will make reasonable efforts to notify you and offer a comparable alternative; if no comparable alternative is available or acceptable to you, you will be entitled to a refund of the amount paid for the affected part of your Package, less any amount that is non-refundable under the cancellation term.
15.4. If you are unable to undertake or continue your Package as scheduled due to a serious medical condition, bereavement, or other significant personal exigency, and you provide the Company with authentic supporting documentation (such as a medical certificate or death certificate) reasonably evidencing the same, the Company may, at its discretion, waive or reduce its own service fee for a modification, or issue a credit note for future use for some or all of the amount that would otherwise be forfeited, in place of a cash refund. Whether to accept such a request, and the extent of any concession, rests solely with the Company, having regard to the amounts recoverable from the relevant Service Providers.
15.5. The itinerary may be adjusted due to natural calamities, weather, road closures, traffic or other delays, safety advisories or local regulations during the trip/tour. In such cases, the Travelers shall agree to cooperate with on-ground coordinators understanding the nature and extent of the case at hand. No refunds or credits shall be offered for itinerary changes mandated by external conditions once the tour has commenced.
16. Cancellation and Refunds
16.1. You may cancel your Booking by notifying the Company, in writing, through WhatsApp or email (official channels). Your cancellation takes effect on the date and time we receive it.
16.2. Cancellation charges depend on the type of Package and when your request is received, as set out below. The Company may publish updated cancellation charges applicable at the time of booking in its Refund and Cancellation Policy or on the relevant Package; where these differ from the table below, the terms communicated to you at the time of booking will apply.
| Package Type | Cancellation Charges (by date your request is received) |
|---|---|
| All Packages | The Booking Amount is non-refundable |
| Domestic group trips | 30 days or more: The Booking Amount and any non-refundable components shall be deducted and the balance is refunded. 15 to 29 days: the Booking Amount and actual costs incurred are deducted and the balance is refunded. 14 days or fewer: 100% of the amount paid is non-refundable. |
| International group trips (short-haul and long-haul) | 60 days or more: the Booking Amount is deducted and the balance is refunded. 30 to 59 days: the Booking Amount and any non-refundable components (such as payments already made for flights, visas or to Service Providers) are deducted and the balance is refunded. 29 days or fewer: 100% of the amount paid is non-refundable. |
16.3. Certain components of your Package (such as flights, non-refundable hotel rates, or event or activity tickets, etc.) may be non-refundable regardless of when you cancel, in accordance with the applicable Service Provider’s terms; this will be indicated to you before you confirm your Package, and any amount attributable to such a component will be deducted before any refund is calculated. Where a component is partially refundable, you will receive only the amount the relevant Service Provider allows the Company to recover, and any cancellation fee charged by a Service Provider will be deducted from the refundable amount.
16.4. Any refund due to you will be processed within five to seven (5-7) business days of the Company’s receipt of your cancellation request, or of the relevant Service Provider processing the corresponding refund to the Company, whichever is later, and will be credited to the original mode of payment unless otherwise agreed.
16.5. The Company reserves the right, at its sole discretion, to decline, suspend, or cancel any Booking, including where it suspects fraud, misuse, or a breach of these Terms, without liability to you beyond the refund (if any) due under this Section.
16.6. Where the Company cancels your Booking, or materially changes your Package and you do not accept the change, in each case for a reason that is not attributable to you, including withdrawal of an Invitation for a reason not attributable to you, a change of Host that you decline, or the Company’s inability to operate the trip; you may elect: (a) an alternative trip or Package of comparable value, subject to availability and to any difference in price; or (b) a refund of all amounts you have paid in respect of that Package. No cancellation charge under this Section applies in those circumstances. This does not apply where the Company cancels because of your breach of these Terms, suspected fraud or misuse, in which case the cancellation charges in this Section apply as though you had cancelled.
16.7. If you fail to present yourself at the specified time and place for any part of your Package (including check-in, departure, or a scheduled pick-up) without prior communication to the Company, this will be treated as a “no-show”. In the event of a no-show, you will not be entitled to any refund, alternative arrangement, or compensation for the missed portion of your Package, and you will remain liable for the full price of your Package.
16.8. If you fail to make any payment by its due date, the Company may, without further notice, treat your Booking as cancelled in accordance with this Section.
16.9. Where your Package is cancelled or modified, whether by you under this Section, by the Company under Section 15.2, or due to a Force Majeure Event under Section 21, the Company shall not be liable for any consequential effect on indirect travel arrangements that do not form part of your Package, including flights, visa applications, or travel insurance, whether such arrangements were made independently by you or with the Company's assistance as an Additional Service.
16.10. Where reasonably possible, the Company will assist you in coordinating an alternative arrangement, and may, at its discretion, offer a credit note or a partial refund for specific components of your Package, strictly in accordance with the applicable Service Provider's refund policies and timelines.
16.11. A group trip shall be subject to a minimum number of Travelers as mentioned in the respective Packages. If this minimum is not met, we may offer an alternative departure date, or another trip. If you do not accept any of these alternatives, you shall be entitled to a credit note or refund of the portion of the Booking, after deducting any non-recoverable costs, including costs incurred towards flights, visas and special permits.
16.12. Short-duration group trips: 15 days or more before departure, the Booking Amount and non-refundable components are deducted and the balance is refunded; 8 to 14 days, the Booking Amount and actual costs incurred are deducted and the balance is refunded; 7 days or fewer, 100% of the amount paid is non-refundable.
16.13. Customised Packages: the cancellation terms stated in your confirmed quote apply. If it states none, then for a domestic Package, 30 days or more before departure the Booking Amount and non-refundable components are deducted and the balance is refunded, 15 to 29 days 75% of the Package price is non-refundable, and fewer than 15 days 100% is non-refundable; and for an international Package, 30 days or more before departure the Booking Amount and non-refundable components are deducted and the balance is refunded, and fewer than 30 days 100% is non-refundable.
16.14. Invite-only Packages, including Hosted Trips, follow the cancellation charges for the relevant group trip type above.
16.15. If only some Travelers on a Booking cancel, the refund for them is calculated under this Section, and you may ask us to apply it to the balance of the same Booking instead of taking a refund. The price for the remaining Travelers may change (for example, because of room sharing), and any difference is payable by you.
16.16. Where we issue a credit note instead of a refund, it is valid for twelve (12) months from the date of issue, may be used only by the Traveler named in it and only towards a future Booking with us, cannot be transferred, and cannot be exchanged for cash. Any unused balance lapses on expiry.
16.17. If your visa is rejected because of an error, omission or missing document on your part, the visa fee and any costs that cannot be recovered are not refundable.
16.18. Nothing in this Section affects the Company’s right to recover any amount that remains due and owing by you under these Terms.
17. Travel Documents and User Responsibilities
17.1. You agree to provide true, accurate, and complete information at the time of Booking (including destination, dates, number and details of Travelers, contact information, and budget), and to promptly notify us of any change.
17.2. It is your sole responsibility to hold a valid passport and to obtain any visa, permit, or travel document required for your itinerary. As a general guide, and without limiting your own diligence: your passport should be valid for at least six (6) months from your date of return, must not be handwritten, must carry a valid barcode, must not be mutilated or tampered with, and the name on it must match the name on all other documents submitted for your Booking.
17.3. We shall not be liable for any loss, cost, or inability to travel arising from denial or delay of a visa, passport ineligibility, or non-compliance with any entry or exit requirement, and no refund shall be payable by us on this account beyond what is recovered from the relevant Service Providers, if any.
17.4. If you are denied entry, refused boarding, or deported by the immigration, customs, or other authorities of any country (for any reason, including incomplete or invalid documentation, visa irregularities, or the discretion of the relevant authority), the Company shall not be liable for any resulting loss, cost, or curtailment of your Package, and no refund shall be payable beyond what is recovered from the relevant Service Providers, if any. You will remain responsible for your own onward or return travel arrangements, and any associated cost, in such circumstances.
17.5. You agree to comply with all health, safety, and travel advisories issued by the Central Government, State Governments, the destination country, or any statutory body applicable to your itinerary. A Service Provider may refuse or curtail service where you fail to comply with such an advisory, and we shall not be liable for such refusal; any consequent refund shall be strictly as permitted by the concerned Service Provider’s policy.
17.6. You are responsible for reviewing all travel-related documents provided, including flight tickets, visa-related documents, insurance documents, itineraries, vouchers and other booking confirmations. Any discrepancy, error or omission identified in such documents must be promptly brought to our attention. We will not be responsible for any loss, delay, inconvenience or other consequences arising from the Traveler’s failure to identify and notify us of any such discrepancy or error within a reasonable time.
18. Travel Insurance
18.1. Travel insurance is mandatory for every international Package. You must obtain, and furnish to the Company proof of, a valid travel insurance policy covering, at a minimum, medical emergencies and evacuation, trip cancellation or curtailment, and loss of baggage, before the commencement of your international Package. The Company may decline to proceed with your Booking, or may decline to allow you to commence your trip, if this requirement is not met, without liability to the Company.
18.2. For a domestic Package, obtaining travel insurance is optional, but is strongly recommended, and remains your own responsibility.
18.3. We do not currently provide or sell travel insurance directly. Customers are responsible for obtaining appropriate travel insurance coverage at their own cost prior to commencing their journey. Where you opt for travel insurance as an Additional Service, the policy is offered by an insurer, through an insurance intermediary registered with the Insurance Regulatory and Development Authority of India where applicable, and the policy and premium receipt are issued to you directly by the insurer. The contract of insurance is between you and the insurer, and its cover, exclusions, excess and claims process are governed by the policy wording, which you should read before you travel. Any claims arising from cancellation, medical emergencies, loss, delay or any other covered event must be made directly with the relevant insurer in accordance with the terms of the applicable insurance policy. We shall not be responsible or liable for any rejection, denial or delay of an insurance claim, or for any loss, cost or expense arising from the customer’s failure to obtain adequate insurance coverage.
19. Medical Disclosure
19.1. You must disclose to the Company any pre-existing medical condition or physical limitation that may affect your participation in your Package, particularly any strenuous or adventure-based component such as trekking, biking, or similar activity. You must also disclose any condition requiring regular medication, any serious allergy, any mobility or accessibility requirement, and any dietary requirement, at the time of your Request or, if it arises later, as soon as you become aware of it.
19.2. The Company may, before confirming your Booking or permitting your participation in any such component, require you to furnish a medical fitness certificate, and may decline your participation where your fitness poses a safety risk to you or to other Travelers.
19.3. Where you fail to make a disclosure required under this Section, the Company may deny you service or exclude you from the relevant component of your Package, without refund or compensation, and shall not be liable for any injury, loss, delay, or disruption arising from an undisclosed condition.
19.4. Dietary, medical and accessibility requests are accommodated where we reasonably can. Outside major cities, and at remote or high-altitude destinations, the options available may be limited, and we cannot guarantee that any particular requirement can be met. Where we are not able to accommodate a requirement safely, we will tell you before you confirm.
20. Adventure and Optional Activities
20.1. Certain Packages may include adventure or other higher-risk activities (such as trekking, water sports, or similar activities). Your participation in any such activity is entirely voluntary and at your own risk.
20.2. The Company shall not be liable for any injury, illness, loss, or damage arising from your participation in such an activity, whether caused by a natural factor, your own conduct, or the act or omission of a Service Provider.
20.3. You must strictly comply with all safety instructions issued by the on-ground operator, activity provider, or Company representative in connection with such an activity. The Company or the relevant Service Provider may exclude you from an activity, without refund, where your conduct is unsafe or non-compliant with these instructions.
20.4. The risk grading, difficulty, fitness level, altitude and any age, health or other eligibility restriction applicable to each adventure activity included in your Package will be stated against that activity in the Package. The Company, the Tour Captain or the activity operator may require you to sign a declaration or waiver in a form approved by the Company before you take part.
21. Force Majeure
The Company will not be liable, or treated as being in default, for any failure or delay caused by circumstances beyond its reasonable control (each, a “Force Majeure Event”). These circumstances include war (declared or undeclared), sabotage, embargo, terrorism, riot or civil commotion, transportation failure, an act of government or of a court or administrative agency, an act of God, fire, explosion, flood, earthquake, strike, epidemic or pandemic, quarantine restriction, or any similar event. You and the Company must each use reasonable efforts to avoid, overcome, and mitigate the effects of a Force Majeure Event. Once the Force Majeure Event ends, these Terms will again operate in full. However, neither party is relieved of an obligation that accrued before the event occurred.

23.3. The Company’s aggregate liability to you arising from or relating to a Booking, however caused, shall not exceed, in aggregate for all claims relating to that Booking, the total amount paid by you for the relevant Package.
23.4. Nothing in these Terms excludes or limits any liability of the Company that cannot be excluded or limited under applicable law, including consumer protection law.
24. Indemnification
24.1. You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) asserted against or incurred by the Company that arise out of, result from, or are payable by virtue of: (a) your breach of these Terms; (b) any information provided by you that is false, inaccurate, or misleading, including in relation to your PAN, foreign exchange usage, or other information provided under Section 13; (c) your violation of any applicable law or any third party’s rights; (d) any arrangement or payment made by you outside the Company’s official channels in breach of these Terms; (e) any act or omission by you during your trip, including damage to property or breach of a Service Provider’s rules; or (f) any misuse by you of Trip Content, of the Company’s or a Host’s intellectual property, or of the personal information of a Fellow Traveler, a Host or any of our personnel; or (g) any claim initiated by a third party due to the your conduct, documentation failures, or non-compliance with tour or destination-specific rules. The Company reserves the right to take such legal action and exercise such remedies as may be available under applicable law for recovery of any losses, costs, damages or expenses arising from or in connection with your default or breach.
