TERMS AND CONDITIONS

1. These terms and conditions ("Terms") govern the conduct of the contest titled The Escape Plan (“Contest”) organized, conducted and brought to you by Enchante Brands Pvt. Ltd. (“Enchante Brands” or “Organizers”). This Contest shall only be for products listed as below: (“Products”):

2. Participation in this Contest is voluntary. The Contest is open to Indian residents, who are eighteen (18) years of age at the time of entry but excludes: (i) employees and the family members of [•], its associate companies, its advertising and promotional agencies and its auditors / executing agencies or anyone else professionally connected with the above; (ii) employees working at Organizers and their respective partners/agencies, their immediate family members, or anyone else associated with organizing and conducting this Contest, (“Participant”).

3. This Contest will be commencing from 02nd July 2025 12:00 AM IST and shall be valid till 6th July 2025 23.59 PM IST (“Duration” or “Contest Period”).

4. Winners will be announced on the 9th, and will be chosen at random.

5. By participating in this Contest, a Participant unconditionally and irrevocably accepts and agrees to be bound by all these terms and conditions as stated herein. Organizers reserve the right to unilaterally modify terms and conditions of this Contest, without any prior notice and liability, expressed or implied. The document also allows [•] to use the images/answers/videos submitted by the participants for promotional means throughout the duration of the Contest and 15 days post the completion of the Contest. By entering into this Contest you hereby provide consent to the Organisers to collect data and utilise the same for the purposes as detailed in these Terms and Conditions. 

6. This Contest is subject to the laws of India and is not offered outside of India.
   
   HOW TO PARTICIPATE-

   1. To participate, the Participant has to follow the steps as detailed herein below- 

   2. The Participant needs to have a valid and public Instagram/ Instagram plus account (“Platform”) and access to the same.

   3. Follow @esc.plan page from the Participant’s profile, Participants must respond to the story hints of @esc.plan  by sending a ‘response’ to @esc.plan (“Entry”). 

   4. The Participant shall repost the Contest video  as a [public story/ post] on their Platform of the Entry which shall remain posted for at least 24 hours from the time of sharing the Entry.  the same shall be treated as a confirmation of the Participant’s Entry and thereby participation in the Contest. 

   5. Entries submitted without following the @esc.plan page, will be considered null and void.

   6. The Contest is valid only for Instagram.

   7. The Organizers reserve their rights to disqualify any Entry at their sole discretion including in the event that any Entry falls under any of the below-mentioned criteria:

   8. Image/video/text video containing objectionable or obscene content (including but not limited to pornography, sexually explicit material, objectionable gestures, etc.) 

   9. Image/video/text containing offensive content including but not limited to abusive language and/or content that may incite violence or discriminate, or spread hate speech based on colour, community, caste, creed, nationality, race, ethnicity, disability (physical or mental), or gender, etc. 

   10. Comments accompanying the images/videos that contain any of the above-mentioned content. 

   11. Any image/audio/video containing content that may violate copyright or the intellectual property rights of any third party. 

   12. Any image/video/text that does not comply with Instagram community guidelines and terms of use or any other policies available at policies.

   13. Entries shall be considered valid for the purpose of the Contest only if the content is not derogatory or offensive in any manner whatsoever and complies with the Instagram terms of use and community guidelines.   

   14. Entry is immoral, defamatory, abusive, offensive, insensitive, libelous or blasphemous to any person, religious sect or section of the society, defamatory of any person deceased or alive, etc. 

   15. contain or displays any commercial/corporate advertising other than that of the Organizers (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements); reference of persons or organizations without their written permission; disparage any persons or organizations; are unlawful, in violation of or contrary to any applicable laws and/or regulations. represent a danger to health and safety or causes fear or distress; or are otherwise offensive or in bad taste.

7. Organizers may take appropriate action on the content if the same does not comply with the community standards as stated above including but not limited to disqualification of the Participant in this Contest as well as any other contest the Organizers may organize.

8. Only one entry per person per account will be accepted during the Duration. Multiple entries from the same person via the same or different account will subject the person to disqualification from the Contest.

9. Entries received after the Duration of the Contest and not in the format prescribed or with incorrect, incomplete, false, or misleading information shall not be entertained and shall be considered ineligible for the Contest.

10. Total 7 participant(s) whose entries are valid and compliant will be selected at random out of which two will be eligible to win the Lucky Prize (defined below) and five will be eligible to win the Contest Prize (defined below) upon the completion of the Contest Period. Winners will be announced within two weeks of completion of the Contest Period. Details will be communicated to the selected Participant by the Organizers through the Participant’s participating Platform. The Organiser's decision shall be final and binding in this regard and cannot be challenged at any occasion. 

11. Mere participation in the Contest does not guarantee winning any prizes.

12. PRIZES: 

1. Contest Prize: 5 Lucky winners Winner will get Travel Voucher Worth Rupees Rs. 5,000, each . 

2. Lucky Prize: 2 Lucky Winners will get the bumper prize, Vouchers worth Rs. 20,000 each.

13. The Prize shall be subject to terms and conditions of the Organizers.

14. The Winner(s) shall be required to share their identification proof, phone number, and address to receive intimation regarding their Prize. In case the winner does not communicate and/or fails to provide the required details within [•] days, they will not be eligible to win the Prize, and the Prize shall be transferred to the next eligible winner. Organizers shall not be responsible for the winner's failure to share the complete and correct details. 

15. The Organizers are not required to entertain/ respond to/ comply with any communication/ request/ claim requiring the Organizers to provide any proof to any Participant or any other party, with respect to details of other Participants, selection of the winner or criteria for same, Contest availed by other Participants etc. Such information will be strictly confidential and shall not be shared with any Participant or any other third party, except as considered necessary in the sole discretion of the Organizers. 

16. The decision of the Organizers shall be final and binding on the Participants and the Participants shall in no event challenge the same at any forum.

17. Participants are strictly prohibited to upload content (picture/text/any other content) of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or against any religious sentiments or against any caste, creed or race or any material including which is offensive to women/ any person or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions or the Code issued by Advertising Standard Council of India. It is also clarified that any entry which is in the reasonable opinion of the Organizers is found to be obscene, offending, abusive and hurtful shall be rejected immediately; and appropriate action will be taken against the said Participant. It is also clarified that no person shall tag a person unnecessarily and/or with an intention to trouble or harass the other person. 

18. At the Organizers’ request, the winners, shortlisted Participants and Participants shall participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and he/she consents to the Organizers using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration/ consideration for the purpose of promoting this Contest of the Organizers’ brand (including any outcome, and promoting any products manufactured, distributed and/or supplied by the Organizers).

19. The Prize and/or the vouchers issued under this Contest is personal to the winners and cannot be transferred under any circumstances.

20. No Cash payment in lieu of the Prize and/or the vouchers issued would be made. Prize and/or the vouchers issued will not be transferable/ exchangeable. The Participant cannot demand any monetary or other compensation in context of the Prize or otherwise. 

21. Organizers shall not be liable for any loss of prize due to any incorrect information provided by the winner.

22. The Organizers shall not be liable for any loss or damage due to reasons beyond their control including act of God, governmental actions, lockdown restriction or other force majeure events and shall not be liable to pay any amount as compensation or otherwise for any such loss. Force majeure event means and includes without limitation any cause affecting the performance of these terms arising from reasons beyond the Organizers’ control or attributable to acts, events, non-happenings, omissions or accidents beyond the reasonable control of any party, and, in particular, but without limitation, shall include strikes, lock-outs or other industrial action, terrorist action or threat of terrorist action, civil commotion, riot, crowd disorder, invasion, war, threat of or preparation for war, fire, explosion, storm, flood earthquake, subsidence, damage including structural damage , epidemic or pandemic other natural physical disaster, lock down, any change in legislation, rule or ruling of government, court or any competent authority.

23. The Participants shall comply with these terms and conditions and waives any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Organizers and their respective affiliates, advertising and promotion agencies, and their respective owners, agents, auditors, representatives, officers, directors and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind relating to, resulting from or arising from this Contest or any product or Prize provided in connection therewith.

24. The Participants and winners shall all times comply with applicable laws.

25. In no event shall the Organizers be liable for any damages, losses, liabilities, injury, or disappointment incurred or suffered by the Participant as a result of participating in the Contest. 

26. Nothing in the Contest or in the advertising/promotional material relating to the Contest shall be deemed to be a permission to use or claim any right or interest in the respective intellectual property of the Organizers. 

27. Participation in this Contest shall always be subject to any other terms and conditions that Meta Platforms Inc. (Instagram) as a social media platform and Escape Plan as a brand may prescribe.

28. By participating in the Contest, each Participant hereby agrees to receive details and information on this Contest, on their respective mobile phones, through SMS or voice calls, during the entire duration of the Contest.

29. The information you provide will only be used as stated in the Terms and Conditions.

30. The information of the Participant shall be collected and stored by Organizers as per their privacy policy available at Instagram platform. 

31. Organizers assume no liability or responsibility for (i) any errors, omissions or inaccuracies of content or submissions, (ii) personal injury or property damage of any nature resulting from Participant’s access to, Participant’s exposure to or Participant’s participation in the Contest (iii) Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information that may be contained therein (iv) any deletion of data or interruption or discontinuance of transmission to or from or through the Contest.

32. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Bangalore, Karnataka only.

33. By participating in this Contest, it is assumed that the Participant has read the terms and conditions and shall be held responsible in case of violation of the same.
