Escape Plan Platform/Store Credits Terms and Conditions

These terms govern all Platform/Store Credits issued by Enchante Brands Private Limited ("Company", "Escape Plan", "we", "us", "our") to a Customer's Escape Plan account, however described, and apply in addition to Escape Plan's general Terms of Use and Privacy Policy.
1. Definitions and interpretation
(a) "Platform Credits" or "Store Credits" or "EscapeCash" means the closed system, prepaid value credits issued by Escape Plan to a Customer's account, redeemable solely in accordance with these terms. Platform Credits issued under a specific promotional offer may also be referred to as a "EscapeCash" in the terms of that offer; references in this document to Platform Credits include any EscapeCash so issued.
(b) "Customer", "you" or "your" means the individual in whose registered Escape Plan account Platform Credits are held.
(c) "Eligible Products" means luggage, backpacks and travel accessories listed for sale on myescplan.com, as updated by Escape Plan from time to time in accordance with clause 11.
(d) "Issuance Date" means the date on which Platform Credits are credited to a Customer's account.
(e) References to the "purchase", "redemption" or "use" of Platform Credits mean the application of a Platform Credit balance towards the price of Eligible Products at checkout on myescplan.com.
(f) Where Platform Credits are issued together with other benefits under a specific promotional offer (such as the Samay Raina x Escape Plan Gift Card Bundle), the terms of that specific offer apply in addition (without duplication) to these general terms in respect of those other benefits. In case of conflict, the specific offer's terms prevail in respect of the benefits unique to that offer, and these general terms prevail in respect of the Platform Credit itself.
2. Nature of Platform Credits
2.1 Platform Credits are a closed system prepaid payment instrument as defined under the Reserve Bank of India's Master Directions on Prepaid Payment Instruments. They are issued and usable only for the purchase of Eligible Products on myescplan.com, and cannot be used to withdraw or transfer money, or to make or receive payment to or from any third party.
2.2 Issuance and use of Platform Credits do not require authorisation as a payment system under the Payment and Settlement Systems Act, 2007. Platform Credits are not "money" or a payment instrument for any purpose other than as set out in these terms.
2.3 Platform Credits are not a deposit, investment or savings product, and do not earn interest.
3. Issuance
3.1 Platform Credits may be issued to a Customer's account (a) on purchase, where a Customer buys Platform Credits for value; (b) as part of a promotional offer, bundle or benefit run by Escape Plan from time to time; or (c) as a goodwill credit, refund-in-kind, or other credit issued at Escape Plan's discretion.
3.2 The amount, source and any terms specific to a given issuance of Platform Credits are communicated to the Customer at the time of issuance and, together with these terms, govern that issuance, unless otherwise modified/ updated by Escape Plan.
3.3 Platform Credits are issued to, and usable only from, the registered Escape Plan account of the Customer to whom they were issued, identified by registered mobile number and email address.
4. Validity and expiry
4.1 Platform Credits are valid for 12 months from the Issuance Date, unless a different validity period is stated at the time of issuance.
4.2 Platform Credits not used within their validity period expire automatically at the end of that period. Expired Platform Credits are forfeited and are not restored, extended, refunded or compensated in cash or kind, except where applicable law provides otherwise.
4.3 Escape Plan may use reasonable efforts to notify Customers of an approaching expiry by email or WhatsApp, but the validity period runs whether or not such a reminder is sent or received.
5. Redemption
5.1 Platform Credits are redeemable only against the purchase of Eligible Products on myescplan.com. They are not valid against any other product category, or on any marketplace, third-party platform or mobile application.
5.2 Platform Credits may be redeemed across multiple orders and in part, until the balance is exhausted or expires, whichever is earlier.
5.3 There is no minimum order value for redemption, unless stated otherwise for a specific promotional offer.
5.4 Platform Credits may be used together with any other live discount, promotion or membership pricing applicable to an order, where expressly stated.
5.5 Where the value of an order exceeds the available Platform Credit balance, the difference is payable by another payment method accepted by Escape Plan.
5.6 Where the value of an order is less than the Platform Credit balance applied, the unused balance remains available for future redemption, subject to clause 4 and the other terms applicable.
6. Non-refundability, transferability and cash value
6.1 Platform Credits are not redeemable or exchangeable for cash, except where required by applicable law. Platform Credits are otherwise non-refundable, subject to the rights expressly provided under these terms and applicable law.
6.2 Platform Credits are linked to the Customer's account and are not transferable to another person or account, except where Escape Plan expressly permits this for a specific issuance.
6.3 Where a Customer's Escape Plan account is closed, suspended or terminated for a breach of Escape Plan's terms of use, any unused Platform Credit balance is forfeited, save as provided by applicable law.
7. Returns and cancellations
7.1 Where an Eligible Product purchased using Platform Credits is returned or the order is cancelled in accordance with Escape Plan's return policy, the portion of the price paid using Platform Credits is credited back to the Customer's Platform Credit balance. It is not refunded in cash or to any other payment method, and remains subject to its original expiry date under clause 4.
7.2 The portion of the price paid by any other payment method is refunded in accordance with Escape Plan's standard return policy for that payment method.
8. Eligibility and account
8.1 Platform Credits may be held and redeemed only by individuals who are 18 years of age or older and resident in India, and who hold a registered Escape Plan account.
8.2 The Customer is responsible for the security of their account credentials and for all redemptions made through their account. Escape Plan is not liable in any manner for unauthorised use of the Customer's registered Escape Plan account or Platform Credits arising from a Customer's failure to secure their account.
9. Fraudulent or prohibited use
9.1 Escape Plan may suspend, withhold or cancel Platform Credits, and may decline a redemption, where it reasonably suspects fraud, abuse of a promotional offer, a breach of these terms, or use in violation of applicable law.
9.2 Platform Credits obtained through fraud, a processing error, or a breach of these terms may be reversed or cancelled by Escape Plan, whether or not they have been redeemed, and Escape Plan may recover the value of any Eligible Products obtained through such Platform Credits.
10. Tax
10.1 Platform Credits are redeemable only against Eligible Products falling within a single product category. Applicable GST is charged in accordance with law and Escape Plan's prevailing tax treatment of Platform Credits, which may involve GST being accounted for at the time of issuance rather than at redemption, depending on the applicable provisions of the CGST Act, 2017 governing Gift Card.
10.2 The price of Eligible Products redeemed against Platform Credits is inclusive of applicable taxes unless stated otherwise at checkout.
11. Amendment and withdrawal
11.1 Escape Plan may amend these terms, the list of Eligible Products, or discontinue the issuance of new Platform Credits, at any time, by posting the updated terms on myescplan.com. Such changes do not affect the validity, redemption scope, or expiry of Platform Credits already issued, except where required to comply with applicable law or to address fraud or misuse.
11.2 Escape Plan may add to/ revise the list of Eligible Products at any time.
12. Limitation of liability
12.1 Escape Plan's liability in connection with Platform Credits is limited to the value of the unredeemed/ unexpired Platform Credit balance in the Customer's account, except for liability that cannot be excluded or limited under applicable law. Customer can seek satisfaction of any such liability only by utilisation of the Platform Credit balance in a manner as contemplated under these terms.
12.2 Escape Plan is not liable for a Customer's inability to redeem Platform Credits including due to circumstances within the Customer's control, and/ or failure to complete a purchase before expiry.
13. Force majeure
Escape Plan is not liable for any failure or delay in issuing or honouring Platform Credits caused by circumstances beyond its reasonable control, including government order or restriction, natural disaster, epidemic or pandemic, or failure of a third-party payment or technology system. Where such a circumstance affects a Customer's ability to redeem Platform Credits before expiry, Escape Plan will, once the circumstance ends, consider at its discretion to extend the validity period by a reasonable period or offer an equivalent remedy.
14. Grievance redressal
Grievance Officer: Khomal Kumar, Lead CX, contactable at care@myescplan.com or +91 97405 08909 (8:00 AM to 8:00 PM IST), in accordance with the Consumer Protection (E-Commerce) Rules, 2020. Complaints will be acknowledged and resolved as required under applicable law.
15. Governing law and jurisdiction
These terms are governed by the laws of India, and the courts at Bengaluru have exclusive jurisdiction.
16. General
16.1 If any provision of these terms is held invalid, illegal or unenforceable by a court or consumer commission of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
16.2 These terms, together with Escape Plan's general Terms of Service and Privacy Policy, constitute the entire agreement between the Customer and Escape Plan in relation to Platform Credits, save for any specific terms communicated at the time of a particular issuance under clause 3.2.
16.3 Where these terms conflict with any advertisement, landing page, or other material regarding Platform Credits, these terms prevail, except to the extent a specific issuance's own terms under clause 1(f) expressly override them.
